PRAYER: Petition filed under Section 482 of Criminal Procedure Code, praying to direct the respondents 1 to 3 to give adequate police protection for the life and limb of the petitioner, his family members and to have peaceful possession and enjoyment of the properties comprised in S.No.42A, Door No.4/87, New Door No.1/87 situated at Amman Sannithi, Vilathikulam Town and Taluk, Thoothukudi, based on the complaint dated 09.05.2020 made before the respondents 1 to 3.

O R D E R

This Criminal Original Petition has been filed seeking a direction to direct the respondents 1 to 3 to give police protection to the life and limb of the petitioner and his family members. 2.Heard the learned Counsel for the petitioner and the learned Additional Public Prosecutor for the respondent police. 3.The learned counsel appearing for the petitioner would submit that the petitioner is a tenant under one V.S.Seenivasan Iyer and as of now, the said V.S.Seenivasan Iyer, is no more. After the death of the said V.S.Seenivasan Iyer, the respondents 5 to 7, who are not related to the said V.S.Seenivasan Iyer, had threatened the petitioner and compelled to execute the lease agreement and also https://hcservices.ecourts.gov.in/hcservices/

CRL OP(MD)No.7391 2020 compelled to pay the rent. In this regard, on 09.05.2020, the petitioner has sent a complaint to the third respondent through online. Though the said complaint was received, no action was initiated by the respondent police and hence, the petitioner has approached this Court.

4.The learned Additional Public Prosecutor appearing for the respondent police, on instructions, would submit that based on the complaint given by the petitioner, the third respondent has initiated an enquiry in C.S.R.No.149 of 2020 on 19.05.2020. At the time of enquiry, both parties appeared and the dispute between them was compromised. Hence, the complaint given by the petitioner was closed, since the dispute between the parties was compromised. 5.In view of the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is closed. However, the respondent police undertakes to give police protection to the petitioner, if necessary.
