RESPONDENT/PETITIONER Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to cancel the bail granted to the respondent/Accused in Crl.O.P.(MD) NO.8587 of 2018 dated 23/05/2018 on the file of this Honourable Court and thus render justice.

Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of MR.A.ROBINSON, Government Advocate (Crl.Side)for the petitioner and of MR.B.PANDIARAJAN, Advocate on behalf of the Respondent, the court made the following order:- The respondent in this Criminal Miscellaneous Petition viz., Thiru.Ravi stands accused in Crime No.85 of 2018 on the file of the Inspector of Police, Sadapatti Police Station, Madurai District. The contraband in quantity is 78 Kilograms of Kanja. During vacation sitting, bail has been granted in favour of the https://hcservices.ecourts.gov.in/hcservices/ accused on 23.05.2018. The satisfaction in terms of Section 37 of NDPS Act has not been recorded. The grant of bail without recording

the satisfaction in terms of NDPS Act, when commercial quantity is involved, is illegal. The bail granted to the respondent in CRL.O.P.(MD).No.8587 of 2018 dated 23.05.2018 is cancelled. 2.Accordingly, CRL.M.P.(MD).No.4150 of 2018 in CRL.O.P.(MD). No.8587 of 2018 stands allowed.
