O R D E R

This Writ Petition is filed seeking a direction to forbear the respondents from establishing Miyawaki Forest at Survey No.157 situated at Thirukolakudi Village, Thiruppathur Taluk, Sivagangai District on the basis of the representation dated 10.03.2023 within a time stipulated by this Court.

2. The learned counsel appearing for the petitioner would submit that the petitioner is the owner of the land in S.No.158/2A situated at Thirukolakudi Village, Thiruppathur Taluk, Sivagangai District and the family members of the petitioner are doing agricultural activities in the said land for several decades. While being so, the 5th respondent is taking steps to develop Miyawaki Forest at Survey No.157, by putting up a pence. He further submits that the said land is used by 2/4

the petitioner as pathway, through which they will carry the agricultural materials. He further submits that there is no other pathway or access to reach his land. In this regard, the petitioner also made a representation on 10.03.2023. However, the same was not considered by the respondents. Hence, the petitioner has approached this Court.

3. The learned Special Government Pleader appearing for the respondents, on instructions, would submit that without obstructing the petitioner's pathway, Miyawaki forest will be established.

4. Recording the submission of the learned Special Government Pleader, this Writ Petition is disposed of. There shall be no order as to costs.
