Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing the 1st, 3rd and 4th respondents to grant permission and protection for the temple festival, Magamayee Drama, Sound Service in the eve of Arulmigu Sri Maruthakaliamman Temple, Panguni festival at Utchapatti village, Thirumangalam taluk, Madurai District on 03.04.2024 at about 10.00 pm to 04.04.2024, 5.00 pm on the basis of the chief electoral officer and Principal Secretary to Government passed vide his proceeding letter No. 2282 / Ele.VIII(2) / 2024-1, dated 20.03.2024 and petitioner representation's dated on 20.03.2024 and within the time limit that may be stipulated.

Heard both sides.

2.The petitioner wants to conduct the petition mentioned Temple Festival. It is an annual event.

3.The fifth respondent is directed to issue "No Objection Certificate" in favour of the petitioner. Based on the same, the petitioner shall approach the Assistant Returning Officer / third respondent. The third respondent will grant permission as sought for. It is open to the third respondent as well as the fifth respondent to stipulate appropriate conditions to ensure that the event is peacefully conducted and as per the model code of conduct that is in force. The petitioner gives an undertaking that he and the organisers of the event will adhere to the conditions.

4.This writ petition is allowed accordingly. There shall be no order as to costs.
