PRAYER: Petition filed under Section 482 of Criminal Procedure Code, praying to direct the 3rd respondent to provide adequate police protection to the life and limb of the petitioner and his family members, based on the petitioner's representation dated 15.06.2020. O R D E R

This Criminal Original Petition has been filed seeking a direction to direct the third respondent to give police protection to the life and limb of the petitioner and his family members. 2.Heard the learned Counsel for the petitioner and learned Additional Public Prosecutor for the respondent police. 3.The learned counsel appearing for the petitioner would submit that the fourth respondent is having a land dispute in respect to the petitioner's ancestral property. On an earlier occasion, this Court directed the Revenue Department to measure the property. Pursuant to which, surveyor was appointed and the property in dispute was measured. Even after measuring the petitioner's property by the Revenue Department, the fourth respondent herein threatening the petitioner and break open the fence put up by the petitioner. In this regard, the petitioner has lodged a complaint before the third respondent on 15.06.2020, for which, no action was initiated. Hence, it is necessary for the petitioner to direct the third respondent to give police protection.

CRL OP(MD)No.7381 2020 4.The learned Additional Public Prosecutor would submit that as of now, no complaint is received from the petitioner and therefore, the respondent police is not in a position to give protection to the petitioner.

5.Considering the fact that the petitioner and the fourth respondent is having a land dispute, if any complaint is given by the petitioner, the third respondent is directed to give protection to the petitioner by way of taking suitable action. 6.In view of the above, this Criminal Original Petition is disposed of.
