PRAYER IN CRL A(MD) No.268 of 2020:

Pleased to call for the records relating to the judgment in S.C.No.16/2017 dated 08.06.2020 on the file of the learned Additional District and Sessions Judge(Fast Track Court), Theni and set aside the same and acquit him from the charge leveled against him.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of Mr.VENKATESWARAN.R., Advocate for the petitioner and of Mr.S.RAVI, Standing Counsel on behalf of the Respondent, the Court made the following order:- This petition has been filed to modify the condition imposed on 1/3

the petitioner in Crl.M.P(MD)No.4111/2020, dated 22.12.2020 in Crl A(MD)No.268/2020.

2. Mr.R.Venkateswaran, learned counsel appearing for the petitioner would submit that the petitioner is staying at Salem and complying with the condition from 11.01.2021. He further stated that the petitioner is a diploma holder in catering technology and in view of the condition imposed on him, he could not go for work.

3. Mr.S.Ravi, learned Standing Counsel appearing for the respondent would submit that the petitioner initially complying with the condition, but he is not complying the condition from 02.04.2021.

4. In reply, the learned counsel for the petitioner would state that in view of the lock down imposed by the Government the Courts are closed and hence, the petitioner is not able to appear before the concerned Court, but he is still staying at Salem.

5. In the light of the above submission, we are inclined to modify the condition imposed on the petitioner in Crl.M.P(MD) No.4111/2020, dated 22.12.2020 in Crl A(MD)No.268/2020 and the petitioner shall appear before the respondent police once in 15 days i.e., first and third Sunday of every month at 10.30 a.m., until further orders.

6. Accordingly, this petition is ordered.
