O R D E R

The petitioner is before this Court seeking issuance of a Writ of Mandamus directing the respondents to correct the date of birth in the petitioner's passport as 05.07.1965 instead of 25.04.1965 and also to correct the petitioner's name as "T.E. Janaarthanann".

2. Mr. P. Murugesan, learned counsel appearing for the respondent, on instructions, submitted that the petitioner is an MBA graduate and that any request for correction of date of birth can be considered only upon production of relevant educational records.

3. The Ministry of Home Affairs, Government of India, has issued guidelines/circulars prescribing the documents that may be produced for issuance or correction of passport particulars. As per the said guidelines, documents such as Aadhaar Card, Elector's Photo Identity Card (EPIC), Service Identity Card issued by the State or Central Government, Birth 2/5

Certificate issued under the Registration of Births and Deaths Act, and other specified documents can be relied upon.

4. In the present case, the petitioner has produced copies of the Aadhaar Card and PAN Card, which indicate the petitioner's date of birth as 05.07.1965. The said documents are recognized identity documents and form part of the acceptable proof for establishing date of birth.

5. In view of the above, this Court is of the opinion that the respondents are bound to consider the petitioner's request for correction of date of birth on the basis of the documents produced, subject to verification in accordance with law.

Accordingly, this Writ Petition is disposed of, directing the first respondent to consider the petitioner's request and re-issue the passport by correcting the date of birth as 05.07.1965 instead of 25.04.1965 in Passport No. M210794213524, dated 19.06.2014, subject to the petitioner satisfying all other requirements. 3/5

7. The above exercise shall be completed within a period of four

(4) weeks from the date of receipt of a copy of this order.

8. Liberty is granted to the petitioner to submit a fresh application for correction of name in the passport, in the manner known to law.

9. No costs.
