This petition has been filed to direct the learned Sessions Judge cum P.C.R.Court, Sivagangai to accept the surrender of the petitioner and to consider the recall warrant petition filed under Section 70(2) of Cr.P.C., on the same day in S.C.No.246 of 2009.

2. When the matter is taken up for hearing, the learned counsel for the petitioner seeks permission of this Court to withdraw this petition and he has also made an endorsement to that effect in the bundle as follows:

"The petition is withdrawn."

3. The said endorsement is recorded. Hence, this Criminal Original Petition is dismissed as withdrawn.
