PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C., praying to transfer the investigation and further to direct the third respondent to forward the petitioner's complaint, dated 07.02.2022 to the second respondent for conducting an enquiry under the Code of Criminal Procedure.

ORDER

This Criminal Original Petition has been filed seeking direction to transfer the investigation and further to direct the third respondent to forward the petitioner's complaint, dated 07.02.2022 to the second respondent for conducting an enquiry under the Code of Criminal Procedure.

2. Admittedly, no case has been registered as against the complaint lodged by the petitioner on the file of the third respondent. Even before registering an FIR, there is no question of change of investigation. Therefore, this Court is not inclined to transfer the complaint, as sought for by the petitioner.

Crl.O.P.(MD) No.7561 of 2022 However, the petitioner is at liberty to lodge a fresh complaint before the jurisdictional Police, in the manner known to law, if so advised.
