..Respondents PRAYER: Criminal Original Petition is filed under Section 482 of Cr.P.C., directing the second respondent to register a case on the complaint of the petitioner dated 02.09.2020, as per the order passed in CMP No.602 of 2021, dated 10.03.2021, on the file of the Judicial Magistrate, Eranel.

ORDER

This Criminal Original Petition has been filed to direct the second respondent to register a case on the complaint of the petitioner dated 02.09.2020, as per the order passed in CMP No.602 of 2021, dated 10.03.2021, on the file of the Judicial Magistrate, Eraniel.

2. The petitioner is the defacto complainant in the above said complaint. The grievance of the petitioner is that even though there is a specific direction by the learned Judicial Magistrate, Eraniel, in CMP No.602 of 2021, dated 10.03.2021, no enquiry has been conducted or First Information Report has been registered by the second respondent. Hence, this petition.

3.When the matter is taken up for hearing, the learned Additional Public Prosecutor would submit that based on the direction issued the learned Judicial Magistrate, Eraniel, case in Crime No.27 of 2021 has been registered on 26.06.2021, for the offences punishable under Section 406 IPC and Sections 4 & 6 of Dowry Prohibition Act.

4. In view of the submission made by the learned Additional Public Prosecutor (Crl.side) that a case has been registered in pursuant to the direction issued by the learned Judicial Magistrate, Eraniel, nothing survives for further adjudication in this Petition. Recording the above submission, this Criminal Original Petition is disposed of.
