S. Muthukrishnan v. Mr. Suresh Kumar
BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT DATED: 07.07.2017 CORAM :
THE HONOURABLE MR.JUSTICE V.BHARATHIDASAN Crl.R.C(MD) No.520 of 2017 S.Muthukrishnan ... Petitioner Vs.
1.Suresh Kumar 2.Jeevamani Dharmaraj 3.Balakrishnan ... Respondents Petition filed under Sections 397 read with 401 Cr.P.C, against the order passed in Cr.M.P.No.2097 of 2016 dated 30.05.2016 by the Judicial Magistrate Court, No.I, Thoothukudi. For Petitioner : Mr.Pinaygash
ORDER
The petitioner filed a complaint alleging that some unknown persons sent letters to a judicial officer in his name. Based on the said complaint, a case has been registered in Crime No.349 of 2015 and after investigation, the police has closed the complaint as undetected. Thereafter, the petitioner has filed a petition under Section 156(3) Cr.P.C., and the same was dismissed. Challenging the order of dismissal, the present Criminal Revision Case has been filed.
2.Heard Mr.Pinaygash, learned counsel appearing for the petitioner.
3.In the petition filed under Section 156(3) Cr.P.C., the petitioner has sought for a direction to the respondent police to register a case. As stated above, based on the earlier complaint given by the petitioner, already a case has been registered in Crime No.349 of 2015 and after investigation, it has been closed as undetected. Hence, the petition filed under Section 156(3) is not maintainable. The Court below after considering the available records, has rightly dismissed the petition. Hence, I find no illegality in the order passed by the Court below. 4.In fine, this Criminal Revision Case is dismissed.
