This Writ Petition has been filed for a Mandamus seeking for a direction to the third respondent to implement the order of the second respondent, dated 05.03.2022 for sub division and issuance of patta in favour of the petitioner in respect of the land comprised in Survey Nos.793/19 and 793/21 (Old S.No. 793-1B, 3C) at Varpattu Village, Ponnamaravathy Taluk, within a time frame to be fixed by this Court.
2.The petitioner has applied for patta for the aforementioned property. He claims that he is the absolute owner of the aforementioned property. He filed documents along with this Writ Petition to substantiate his claim.
3.It is for the respondents to consider the same on merits and in accordance with law. The petitioner's application seeking for issuance of patta has already been recommended, as seen from the order, dated 05.03.2022 issued by the second respondent. But, according to the petitioner, till date, patta has not been issued by the third respondent, who is the competent authority. W.P.(MD)No.7812 of 2022 4.Heard Mr.A.Srinivasan, learned Counsel for the petitioner and Mr.D.Sasikumar, learned Additional Government Pleader, who accepts notice on behalf of the respondents.
5.No prejudice will be caused to the respondents, if a direction is issued to the respondents to pass final orders with regard to the petitioner's application seeking for issuance of patta for the aforementioned property on merits and in accordance with law after affording a fair hearing to the petitioner and any other necessary party whom the third respondent deems fit to enquire. 6.For the foregoing reasons, this Court directs the third respondent to pass final orders on the petitioner's application seeking for issuance of patta in his favour in respect of the property comprised in Survey Nos.793/19 and 793/21 (Old S.No. 7931B, 3C) at Varpattu Village, Ponnamaravathy Taluk, in the light of the recommendation made by the second respondent in his order, dated 05.03.
2022, on merits and in accordance with law after affording a fair hearing to the petitioner and any other necessary party whom the third respondent deems fit to enquire, within a period of twelve weeks from the date of receipt of a copy of this order. 7.With the aforesaid directions, this Writ Petition is disposed of. No costs.
