ORDER : The Court made the following order :- Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent.
2.The petitioner, who apprehends arrest at the hands of the respondent Police, for the alleged offences punishable under section 379 IPC, 4(1) (1A) and 21(1) of Mines and Minerals (Development & Regulation) Act 1957 in Crime No.125 of 2021, on the file of the respondent police, seeks anticipatory bail.
3.The case of the prosecution is that the petitioner is illegally transported 1 1⁄2 unit of sand. Hence, the complaint. 4.The learned counsel appearing for the petitioner submits that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution, but, a false case has been foisted as against him.

CRL OP(MD). No.7812 of 2022 5.The learned Government Advocate submits that earlier applications filed by the petitioner were dismissed by this Court, on the ground that the petitioner is having three previous cases pending against him.
6.It appears that the application filed by the petitioner is without referring the change of circumstances to consider the case. Since there is no change in circumstances, after the dismissal of earlier petition, this Court is not inclined to grant anticipatory bail to the petitioner.
