PRAYER : Civil Revision Petition is filed under Article 227 of Constitution of India to direct the learned Subordinate Judge, Kumbakonam to conclude the H.M.O.P.No. 317 of 2024 pending on the file of the Subordinate Court, Kumbakonam within a time frame that may be stipulated by this Court. For Petitioner :Ms.M.Niranjana Devi *****
ORDER
This Revision Petitioner seeks expeditious disposal of H.M.O.P.No.317 of 2024 pending on the file of the Subordinate Court, Kumbakonam. 2.HMOP seems to have been presented as H.M.O.P.No.75 of 2023 on the file of the Subordinate Court, Neyveli. Pursuant to the direction of the Principal Seat,
in Tr.C.M.P.No.1002 of 2023, dated 14.06.2024, the proceedings have been withdrawn from the Subordinate Court, Neyveli and transferred to the file of the Subordinate Court at Kumbakonam.
3.The husband has sought expeditious disposal of the said proceeding. 4.By an order, dated 18.03.2026, I called a report from the Principal Subordinate Judge at Kumbakonam. The report has been sent to this Court on 28.03.2026. Perusal of the report shows that the wife has filed an application for interim maintenance in I.A.No.27 of 2026 and the same is pending consideration. In the interregnum, the petitioner has moved this revision for the aforesaid relief. 5.When an application for interim maintenance is pending, there cannot be a direction for disposal of the HMOP. Hence, the Civil Revision Petition is dismissed. No costs.
