ORDER : The Court Made the following order :- The petitioners/Accused Nos.1 to 4, who were arrested and remanded to judicial custody on 29.11.2016 for the alleged offences punishable under Section 365 of I.P.C, in Crime No.161 of 2016 on the file of the respondent police and hence, seek bail. 2.The case of the prosecution is that the son of the defacto complainant was draped by the accused persons.
3. The learned counsel for the petitioners submitted that there are totally five accused in this case and the petitioners herein are A-1 to A-4 respectively and they were arrested and remanded to judicial custody from 29.11.2016 onwards.
4. The learned Government Advocate(Crl. Side) on instructions would submit that the occurrence took place on 02.09.2016 and the F.I.R was registered on 04.09.2016 on the basis of the complaint given by the mother of the victim and the amount demanded is also not paid by the defacto complainant herein and the victim has returned to home without any injury.
5. Considering the above facts and circumstances of the case and also considering the fact that the alleged demand is not complied with and the victim has also returned to home and the https://hcservices.ecourts.gov.in/hcservices/
period of incarceration undergone by the petitioners, this Court is inclined to grant bail to the petitioners with certain conditions. Accordingly, the petitioners are ordered to be released on bail on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned District Munsif-cum-Judicial Magistrate, Vadipatti, Madurai District and on further condition that the petitioners shall appear before the respondent police daily at 10.30 a.m., for a period of four weeks.
