Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, directing respondents 1 to 5 to forbear respondents 6 to 10 from conducting the exhibition without obtaining permission from respondents 1 to 5, the said exhibition is scheduled to be conducted from 12.03.2026 to 20.03.2026, based on the petitioners representation dated 02.02.2026 and pass such further or other orders as this Honble Court may deem fit and proper in the circumstances of the case and thus render justice. ORDER

This writ petition is filed for a direction to the respondents 1 to 5 to forbear respondents 6 to 10 from conducting the exhibition without obtaining permission from respondents 1 to 5, the said exhibition is scheduled to be conducted from 12.03.2026 to 20.03.2026, based on the petitioners representation dated 02.02.2026.

2. Heard Mr.R.G.Shankar Ganesh, learned counsel for petitioner, Mr.M.Lingadurai, learned Special Government Pleader, who takes notice for R1, R2, R4 & R5 and Mr.R.Suresh Kumar, learned Additional Government Pleader, who takes notice for R3.

3. By consent, the writ petition is taken up for final disposal at the admission stage itself.

Upon hearing the learned counsel for the petitioner and perusing the material records of the case, it is the case of the petitioner that S.No.39/10, admeasuring to an extent of 3 acres and 27 cents belong to one Kailasa Madam and it was originally administered by the petitioner's ancestors and the petitioner has now filed O.A.No.4 of 2021 and the same is pending for framing of scheme in respect of the said Kailasa Madam. While so, without any permission of the petitioner or from the (HR & CE) Authorities, now the exhibition is proposed to be conducted and third parties are installing the necessary equipments and other stalls for the purpose of conducting an exhibition without paying any rent to the said Kailasa Madam.

5. Since the petitioner contends that the property belongs to the madam as a religious endowment under the authorities, the 5th respondent is directed to conduct an enquiry in this regard. After conducting such enquiry, if it is found that the persons are in unauthorized occupation, appropriate steps shall be taken either to evict them or to collect rent from them in favour of the madam, as the case may be. The entire exercise shall be carried out by coordinating with the revenue and other authorities within a period of two weeks from the date of receipt of the web copy of this order, without waiting for the certified copy of the order.

Considering the nature of other allegations made, without expressing any opinion on the merits of the matter, the 5th respondent is directed to conduct an enquiry based on the petitioner's representation dated 02.02.2026 and pass final orders on its own merits and in accordance with law, within a period of two weeks from the date of receipt of a web copy of the order, without waiting for the certified copy of the order.

7. The writ petition is disposed of with the above directions. No costs. Consequently, connected miscellaneous petition is closed. 12.03.2026 Index: Yes Speaking Order: Yes rgm 5/6
