To allow the writ appeal and set-aside the order passed by this Hon'ble Court in W.P.(MD)No.14277 of 2013 dated 28.01.2022.

To issue a Writ of Certiorarified mandamus or any other order or orders or direction, in the nature of writ, calling for the records pertaining to the impugned orders dated 23.01.2010 passed by the 3rd Respondent, disciplinary authority imposing upon the petitioner punishment of "Dismissal without notice" and the order dated 23.02.2011 passed by the 4th Respondent, appellate authority rejecting the appeal and confirming the punishment of Dismissal with out notice imposed upon the petitioner by the 3rd Respondent and quash the same as arbitrary, illegal and unconstitutional and consequently direct the respondents to reinstate the petitioner with all consequential benefits.
ORDER : This Civil Miscellaneous petition coming up for orders on this day, upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of M/S.V.O.S.KALAISELVAM, Advocate for the petitioners and of MR.R.KAVIN PRASATH, Advocate on behalf of the Respondent, the court made the following order:- 2/4
(Order of the Court was made by D.KRISHNAKUMAR, J.) This petition is filed to condone the delay of 393 days in filing the W.A.[MD] SR.No.23166 of 2023.
2.The learned Counsel appearing for the respondent objected for allowing this petition.
3.We have gone through the affidavit filed in support of this petition. On going through the affidavit, we find that there is no whisper about the reasons or explanations for filing this appeal with enormous delay. Though normally we are not inclined to condone such inordinate delay, considering the fact that there is no objection for the respondent in allowing this petition, we are inclined to condone the delay on payment of cost. Therefore, the delay is condoned and this petition is allowed on payment of Rs.5000/- (Rupees Five Thousand Only) to the respondent within a period of two [2] weeks from today.
