Respondents PRAYER : Writ Petition is filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus to direct the 2nd respondent to conduct proper enquiry to correct the wrong entry of survey number in the Patta No.514 issued by the 2nd respondent in terms of the proceedings of the 1st respondent in O.Mu.C3/6938/2020 dated 20.07.2020.

ORDER

This writ petition has been filed for the issue of a writ of mandamus directing the second respondent to correct the entry in the patta issued in Patta No.514 in terms of the proceedings of the first respondent dated 20.07.2020.

2.The case of the petitioner is that he is the owner of the subject property and he was also issued with patta. The petitioner found that instead of mentioning the survey number 372/7, a wrong entry was made as S.No.372/9. The petitioner therefore made representation to the respondents seeking for the correction in the patta.

3. The first respondent, on receipt of the representation, directed the second respondent to act upon the representation and to conclude the proceedings. Even thereafter the petitioner had made a representation on 14.08.2020. Since the same was not acted upon, the present writ petition has been filed before this Court seeking 1/3

appropriate directions.

4. Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents.

5. Taking into consideration the facts and circumstances of the case and the limited relief sought for in this writ petition, there shall be a direction to the second respondent to act upon the representation made by the petitioner on 27.06.2020 and carryout the necessary correction in the revenue records and issue corrected patta in favour of the petitioner within six weeks from the date of receipt of a copy of this order. If there are any other interested parties claiming right over the subject property, they shall also be issued with notice and an opportunity shall also be given to them.

6. The petitioner is directed to make a fresh representation to the second respondent along with all the relevant documents and also a copy of this order.

7. This writ petition is disposed of with the above direction. No costs.
