O R D E R

The Writ Petition has been filed praying for issuance of a Writ of Mandamus, directing the respondent to dispose the Election Petition in No.2 of 2013, on the file of the respondent, seeking relief of recounting of votes for the election of board members held on 27.04.2013 for Y46, Primary Agricultural Co-operative Society, Saral at Kanyakumari District.

2. The case of the petitioner is that the election 2013-2017 for the board members in Y46, Primary Agricultural Co-operative Society, Saral at Kanyakumari District was held on 27.04.2013. Subsequently, the election result was declared on 30.04.2013. The petitioner was an eligible voter holding membership No.878 of the said Society and contested in the election. Apart from that 23 members also contested in the venue of the election for the board member. Out of the total 24 contesting members, 11 shall be elected, as per the procedure. lapse of more than 2-1/2 years, till date, the election petition was not disposed of by the respondent. Hence, the present writ petition.

3. I have heard the submissions made on either side and perused the materials available on record.

4. Considering the facts and circumstances of the case, without going into the merits of the matter, this Court, directs the respondent to dispose of the Election Petition in No.2 of 2013, on merits and in accordance with law, within a period of eight weeks, from the date of receipt of a copy of this order.

5. With the above direction, the Writ Petition is disposed of. No costs.
