ORDER : The Court Made the following order :- The petitioner/A-1, who was arrested and remanded to judicial custody on 17.11.2016 for the alleged offences punishable under Sections 363, 379(NP) of I.P.C, in Crime No.639 of 2016 on the file of the respondent police and hence, seeks bail.
2. The case of the prosecution is that the petitioner along with other accused kidnapped one Pandiarajan. 3.The learned counsel for the petitioner states that the petitioner was arrested and remanded to judicial custody on 17.11.2016 and the victim returned to home and the respondent foisted a false case against the petitioner herein.
4. The learned Government Advocate(Crl. Side) appearing for the respondent on instructions submitted that totally there are four accused in this case. A-1 to A-3 were arrested on 17.11.2016 and A4 is still absconding. It is alleged that the accused persons are partners in the business of selling and buying old cars and the friend of the defacto complainant namely Pandiarajan was abducted by the petitioners along with other accused for the balance sum to be paid by him to the tune of Rs.30,000/- and the investigation is still pending.

5. Considering the above facts and circumstances of the case and also considering the fact that the petitioner is in prison from
17.11.2016 onwards and the victim himself returned to home, this Court is inclined to grant bail to the petitioner with certain condition. Accordingly, the petitioner is ordered to be released on bail on each his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Thirumangalam, Madurai District and on further condition that the petitioner shall appear before the respondent police daily at 10.30 a.m., until further orders.
