O R D E R

The Writ Petition is filed seeking a direction to the respondents to rectify the error in the village field map indicating pathway in S.No163, situated at Managiri, Sukkanendhal Village, Patharakudi Ukkadai Ellankaatan Kanmai Wet land (pasana Nanjai) by considering the Petitioner's representation, dated 19.1.2023.

2.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 3.According to the Petitioner, he is the power of Attorney Holder in respect of the subject property. The original owner of the property namely, Arul Raja executed a power deed in favour of the Petitioner under registered document, dated 30.8.2022. It is stated by the Petitioner that the subject property is a wet land and in the Village Field Map, a pathway has been indicated 2/5

erroneously when there is no pathway on ground. Therefore, he submitted a representation seeking cancellation of the pathway from the revenue records.

4.The third respondent filed a counter affidavit asserting that there is a cart track on ground in the subject property and the same has been in use for several years.

5.In view of the definite stand taken by the third respondent in his counter affidavit, this Court is inclined to issue a direction to the second respondent to consider the representation of the Petitioner, dated 19.01.2023, conduct an enquiry and pass final orders on its own merits after affording reasonable opportunity to the Petitioner and other interested parties, if any, within a period of 12 weeks from the date of a copy of this order. 6.With the above directions, the Writ Petition stands disposed of. No costs.
