O R D E R

The petitioner has filed this criminal original petition, under Section 482 of the Code of Criminal Procedure, seeking for a direction to the third respondent to register a case, based on her complaints, dated 26.04.2018 and 28.05.2018.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents and perused the materials placed on record.

3. The learned counsel for the petitioner submitted that the petitioner has been in possession and enjoyment of the property in dispute, but the proposed accused have unlawfully entered into the same and stolen motor pumps and other articles. https://hcservices.ecourts.gov.in/hcservices/

4. The learned Government Advocate (Criminal Side) submitted that based on the petitioner's complaints, dated 26.04.2018 and 28.05.2018, petition enquiry is pending.

5. In view of the above submissions, this Court directs the respondent - Police to proceed with the enquiry in accordance with law and during the course of enquiry, if any cognizable offence is made out, the respondent - Police shall register a case based on the petitioner's complaints, dated 26.04.2018 and 28.05.2018 and proceed further in accordance with law and if no cognizable offence is made out, the further action shall be dropped.

6. The criminal original petition is disposed of with the above observations.
