Criminal Original Petitin is filed under Section 482 of Cr.P.C to direct the 2nd respondent to execute the non bailable warrant pending against the accused no.1 in C.CNo.393 of 2011 on the file of the Judicial Magistrate, Uthamapalayam, Theni District pertaining to Cr.No.10 of 2011.
ORDER:- This Criminal Miscellaneous petition coming on for orders on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of Thiru K.K.RAMAKRISHNAN, ADDITIONAL PUBLIC PROSECUTOR, Advocate for the Petitioners, this Court made the following order: This Court, by an order dated 30.08.2018, directed the second respondent to execute the Non-Bailable Warrant pending against the said Raja Mohamed, who is cited as A1 in C.C.No.393 of 2011 within a period of four weeks from the date of receipt of a copy of this order. Subsequently, the time has been extended by four more weeks, by an order dated 29.03.2019. Now, seeking extension of time to https://hcservices.ecourts.gov.in/hcservices/ 1/2
CRL MP(MD). No.4875 of 2019 execute the Non-Bailable Warrant, the present petition has been filed.
2. The learned Additional Public Prosecutor on instructions would submit that the second petitioner taking sincere efforts to execute the warrant. Since he was deputed for Parliament Election Bandobust duty, and the whereabouts of the accused is not known, in the above circumstances, they are not in a position to comply with the order passed by this Court.
3. Considering the facts and circumstances of the case, time already granted by this Court is extended by two more months from the date of receipt of a copy of this order.
