(MD)No.8214 of 2024) Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, forbearing the respondent No.2 and 4 to 6 or their subordinate, men and servants from utilizing or converting the land which was earmarked for public purpose / community purpose in Vee Ess Vee Nagar Residential colony in layout approval No. TP / DTP / 123/66 and revised layout No.158 / 67 (on the file of the 1st respondent) in Sivakasi Town Survey Number 25/1A and 25/1A in Virudhunagar District, by considering the petitioner's representation dated 01.02.2024 within the time stipulated by this Court.

ORDER

This Writ Petition has been filed to forbear the respondents 2 and 4 to 6 from utilizing or converting the land which was earmarked for public 2/6

purpose / community purpose in Vee Ess Vee Nagar Residential colony in layout approval No.TP / DTP / 123/66 and revised layout No.158 / 67 (on the file of the 1st respondent) in Sivakasi Town Survey Number 25/1A and 25/1A in Virudhunagar District, by considering the petitioner's representation dated 01.02.2024.

The learned counsel appearing for the petitioner would submit that the petitioner has given a representation on 01.02.2024 to forbear the respondents 2 and 4 to 6 from utilizing or converting the land which was earmarked for public purpose / community purpose in Vee Ess Vee Nagar Residential colony. However, the same is yet to be considered. Hence, the Writ Petition.

3. The learned Government Advocate appearing for the respondents would submit that the Commissioner, Sivakasi Municipal Corporation is appropriate authority to consider the representation of the petitioner. He therefore prayed for appropriate orders.

4. In view of the above submission, the Commissioner, Sivakasi Municipal Corporation is suo motu impleaded as the seventh respondent in this Writ Petition.

5. Mr.A.Oliraja, learned Government Advocate takes notice for the seventh respondent.

In view of the same, without expressing any opinion on the merits of the matter, this Court directs the sixth respondent to forward the representation of the petitioner dated 01.02.2024 to the seventh respondent within a period of two (2) weeks from the date of receipt of a copy of this order and the seventh respondent, in turn, is directed to consider the representation of the petitioner dated 01.02.2024 and dispose of the same, on its own merits and in accordance with law, within a period of eight (8) weeks thereon. It is made clear that, interim order of injunction already granted by this Court shall continue until the disposal of the representation of the petitioner.

7. With the above direction, this Writ Petition stands disposed of. No costs. Consequently, connected Miscellaneous Petition is closed. 18.02.2026 Speaking / Non-speaking order Index : Yes/No NCC : Yes/No mbi 4/6
