PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to call for the records in C.C.No.71 of 2015 on the file of the learned Judicial Magistrate, Thiruvaiyaru and quash the same.

ORDER

The present petition has been filed by the 3rd accused seeking to quash the charge sheet in C.C.No.71 of 2015 on the file of the learned Judicial Magistrate, Thiruvaiyaru, wherein the petitioner is alleged to have committed offences under Sections 420 & 493 of IPC.

2. Pending trial, the parties have entered into a compromise, wherein, the defacto complainant has agreed for quashing of the charge sheet.

3. The defacto complainant is present in-person before this Court and she submits that she had agreed for quashing of charge sheet as against the petitioner.

4. Considering the above said facts, charge sheet in C.C.No.71 of 2015, on the file of the Judicial Magistrate, Thiruvaiyaru is hereby quashed as against the petitioner/Accused No.3.
