Respondent Prayer : Writ Petition is filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Mandamus, directing the respondent to settle the loan dues of sum of Rs. 1,66,02,233/- being recovered by him from the members/employees of the petitioner's society for the period from June 2022 to Dec 2025 along with the 14.5 percentage of interest, so as to compensate the interest occurred by it, within the stipulated time that may be fixed by this Court.

ORDER

This writ petition is filed for issuing a writ of mandamus directing the respondent to settle the loan of Rs.1,66,02,233/- borrowed from the members/employees of the respondent municipality.

2. The employees of the respondent municipality had borrowed loan from the petitioner society and as per the norms and regulations the respondent/employer mandatorily required to deduct the monthly instalments or loan amount from the salary of the employees. However, the respondent has deducted loan amount from the salary of the employees and not remitted the same to the petitioner society.

3. The petitioner's grievance is that the respondent has not deposited the loan amount deducted from the employees to the petitioner society.

4. Hence, the respondent is directed to consider the representation of the petitioner dated 17.12.2025 on its own merits and pass appropriate orders in accordance with law within a period of six(6) weeks from the date of receipt of a copy of this order.
