PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to direct the learned Principal District and Sessions Judge, Karur, accept the memo filed by the petitioner dated 08.08.2025 and dispose the C.A.No.140 of 2025 on the basis of the memo filed by the petitioner and pass any other suitable order.

ORDER
The present petition has been filed by the appellant/accused in C.ANo. 140 of 2025, on the file of the Principal District and Sessions Court, Karur, seeking a direction to the concerned Court to accept the memo filed by the petitioner on 08.08.2025.

The petitioner herein has suffered an order of conviction before the trial Court, namely, the learned Judicial Magistrate No.II, Karur, in S.T.C.No. 3416 of 2023, under Section 138 of Negotiable Instruments Act. Challenging the same, the petitioner has preferred an Appeal in C.A.No.140 of 2025, which is pending before the Principal District and Sessions Court, Karur. When the appeal is pending, the petitioner has filed a memo on 08.08.2025 to the effect that he is ready to settle the case as per the law amicably in the light of the judgment of the Hon'ble Supreme Court. However, so far the memo has not been taken into consideration by the Appellate Court and hence, the present petition.

3. Considering the fact that the petitioner is ready to settle the amount as per the guidelines issued by the Hon'ble Supreme Court in 2025 INSC 1158 in Crl.A.No.1755 of 2010, Sanjabij Tari Vs. Kishore S.Borcar and another, especially in paragraph No.37, there shall be a direction to the Principal District and Sessions Judge, Karur, to accept the said memo dated 08.08.2025 and proceed to dispose of the same in the light of the judgment cited supra.
4. With the above said observations, this Criminal Original Petition stands disposed of.
