PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Certiorarified Mandamus to call for the records relating to the impugned order of suspension issued by the first respondent in R.C.No.10597/2020/K.4 dated 21.10.2020 and to quash the same and consequently directing the respondents to reinstate the petitioner into service, with all consequential and other attendant benefits.

O R D E R

This Writ Petition is filed as against the order of suspension passed by the first respondent in R.C.No.10597/2020/K.4 dated 21.10.2020.

2.The petitioner, who is working as Block Development Officer in Rural Development Department has been placed under suspension by the order impugned in this Writ Petition. 3.The learned Additional Government Pleader submits that now charge memo has been issued as against the petitioner on 18.08.2021 and enquiry officer is yet to be appointed. 4.Since charge memo has already been issued, this Court without expressing anything on the claim of the petitioner is https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P(MD)No.8939 of 2021 inclined to dispose of this writ petition, with the direction to the respondents to appoint an enquiry officer within a period of two weeks from the date of receipt of a copy of this order and the enquiry officer shall conduct the enquiry and conclude the same within a period of twelve weeks from thereon. The impugned order is restored. The petitioner shall co-operate with the enquiry and the respondents shall also place all the materials before the enquiry officer.

5.Accordingly, this writ petition is disposed of. No Costs. Consequently, W.M.P(MD)Nos.6739,6741,6743 & 11281 of 2021 are closed.
