ORDER

The petition has been filed for a direction to the respondents 1 and 2 to give necessary police protection to the life and limb of the petitioner and his family members on the basis of the petitioner's representation dated 23.01.2016.

2.Heard the learned counsel for the petitioner, learned counsel for the third respondent and the learned Government Advocate (Crl. Side) for the respondents 1 and 2.

3.It is seen that there is a dispute pending among the family members of the petitioner with regard to the partition of the property in connection with which a suit for partition is pending and the same is now pending as second appeal in SA No.2069 of 2002 before this Court. While so, it is alleged that the 3rd respondent has caused extensive damage to the house of the petitioner.

https://hcservices.ecourts.gov.in/hcservices/ 4.The learned counsel for the 3rd respondent submitted that the said house belongs to him, which is strongly refuted by the learned

counsel for the petitioner. The third respondent was not able to produce any document to show that he has the authority to demolish a house and any permission from panchayat or municipality. 5.The learned Government Advocate (Crl. Side) submitted that the police have registered a case in Crime No.192/2016 against the 3rd respondent under Sections 147, 148, 448, 427, 342 and 506(ii) IPC.

6. In view of the above, the respondent police is directed to provide sufficient police protection to the petitioner against any harassment by the 3rd respondent.
