PRAYER :- For Anticipatory Bail in Crime No.4/2024 on the file of the Respondent Police. ORDER : The Court made the following order :- The petitioners, who are arrayed as accused, apprehending arrest at the hands of the respondent Police for the offences punishable under sections 423,, 465, 468, 471, 420 and 120B IPC in Crime No.04 of 2024 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that the petitioners herein have created forged death certificate and legal heir certificate of one Nagammal w/o. Arumugam, while she is alive and based on the above said documents the petitioners herein had sold the property to one Kalaiyarasi for a sum of Rs.2,10,00,000/-. Hence, the complaint.
3. The learned counsel appearing for the petitioners would submit that petitioners are innocent and their names have been falsely implicated in this case.
4. The learned Additional Public Prosecutor appearing for the respondent 2/4
would submit that A1 / 1st petitioner has prepared false death certificate of one Panchavarnam's parents and legal heir certificates of said Panchavarnam and the same was fully aware by the other accused. He would further submit that amount involved in this offence is very hug and hence, he strongly opposed to grant anticipatory bail to the petitioners.
5. The learned counsel for the intervenor submitted that the petitioners herein have created forged death certificate of alive person and thereby, cheated a huge sum of Rs.2,10,00,000/- and prays for dismissal of this petition.
6. Considering the submission made by the learned counsel appearing on either side and also considering the serious nature of allegations made against the petitioners, this Court is not inclined to grant anticipatory bail to the petitioners.
