... 2nd Respondent/Respondent/Respondent PRAYER: The Criminal Revision case is filed under section 397 r/w 401 of Cr.P.C. to call for the entire records pertaining to the order dated 28.08.2017 in Cr.M.P.No.1455 of 2017 in C.A.No.73 of 2017 pending on the file of the learned District and Sessions Judge, Dindigul and to set aside the 1st condition of the said order by allowing this Criminal Revision Case. O R D E R
The learned counsel for the petitioner and the learned counsel for the respondent are present and heard. 2.This Criminal Revision Case is filed against the order dated 28.08.2017 in Cr.M.P.No.1455 of 2017 in C.A.No.73 of 2017 passed by the learned District and Sessions Judge, Dindigul. 3.While suspending the sentenced imposed on the petitioner, the Appellate Court has imposed a condition, directing him to deposit a sum of Rs.57,000/- out of Rs.1,70,000/- before the Judicial Magistrate, Kodaikanal on or before 03.10.2017. The Trial Court has directed the petitioner to pay the compensation of Rs.1,70,000/- to the respondent herein and against the said order of the Trial Court, an appeal in C.A.No.73 of 2017 is preferred and the same is pending.
4.The learned counsel for the petitioner seeks permission to withdraw this Criminal Revision Case and requested this Court for granting one month further time for making such deposit. https://hcservices.ecourts.gov.in/hcservices/
5.Recording the above, this Criminal Revision case is dismissed as withdrawn by granting one month further time for depositing a sum of Rs.57,000/- before the Judicial Magistrate, Kodaikanal in C.C.No.55 of 2009 from the date on which the order copy is made ready. The Appellate Court is directed to dispose of the appeal within a period of two months from the date of depositing the said amount by the petitioner herein and report to the Registrar (Judicial), Madurai Bench of Madras High Court. Consequently, connected Crl.M.P.is closed.
