ORDER
This Criminal Miscellaneous Petition is filed by the petitioner /accused to suspend the sentence imposed as against him by the learned Sessions Judge, Mahila Court, Madurai, in S.C.No.67 of 2022, dated 30.01.2024. 2.There are two accused and the petitioner is the first accused. They were charged for the offence u/s.341, 294(b), 506(ii), 366, 376(d) IPC. The trial Court has found the accused guilty for the offence u/s.506(ii), 366, 376(d) IPC, convicted and sentenced 1/6
them as follows:- • to undergo rigorous imprisonment for twenty years and to pay a fine of Rs.10,000/-, each, in default, to undergo simple imprisonment for one year, for the offence u/s.376(D) IPC;
• to undergo rigorous imprisonment for ten years and to pay a fine of Rs.10,000/-, each, in default, to undergo simple imprisonment for one year, for the offence u/s.366 IPC;
• to undergo rigorous imprisonment for two years and to pay a fine of Rs.5,000/-, each, in default, to undergo simple imprisonment for three months, for the offence u/s.506(ii) IPC.
Challenging the conviction and sentence, the petitioner / first accused filed Crl.A (MD)No.159 of 2024. Pending the appeal, in order to suspend the sentence, he has moved this miscellaneous petition.
3.Learned Counsel for the petitioner/appellant, by relying upon the order passed by this Court in Crl.MP(MD)No.10498 of 2024, submitted that this Court has already suspended the sentence imposed on the second accused and therefore, prayed for parity.
4.Learned Government Advocate (Crl. Side) appearing for the State raised serious objections and submitted that the petitioner is a history sheeted rowdy having 32 2/6
previous cases to his credit. If the petitioner comes out on bail, then he would indulge in similar offence. Considering the same, this Court has dismissed the earlier application filed by the petitioner for suspending the sentence. There is no change in circumstances and therefore, he prayed for dismissal. 5.This Court considered the submissions made by the learned Counsel on either side and perused the materials placed on record.
