PRAYER : Criminal Original Petition filed under Section 482 of Criminal Procedure Code, directing the 3rd respondent to expedite the investigation and file the charge sheet as against all the accused in connection with Crime No.16 of 2023 on the file of the 3rd respondent by considering the petitioner's daughter representation dated 25.02.2023. 1/5

ORDER

This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., directing the 3rd respondent to expedite the investigation and file the charge sheet as against all the accused in connection with Crime No.16 of 2023 on the file of the 3rd respondent by considering the petitioner's daughter representation dated 25.02.2023.

Today, when the matter is taken up for hearing, learned Additional Public Prosecutor appearing for the respondent police would submit that based on the complaint lodged by the petitioner, the respondent police registered an FIR in Crime No.16 of 2023 and the investigation is in progress. He further submitted that so far six witnesses have been examined and a proposal has been sent to delete the some of the accused's name in the FIR. He further submitted that within a short time, the entire investigation will be completed and the final report will be filed before the concerned Court.

3. Recording the submission made by the learned Additional Public Prosecutor, the respondent police is directed to complete the investigation and file a final report in Crime No.16 of 2023 before the jurisdictional Magistrate Court, within a period of five months from the date of receipt of a copy of this order. After filing the final report, if the petitioner is still aggrieved by the contents of the final report, he can workout his remedy through the appropriate proceedings. With the above direction, this Criminal Original Petition stands disposed of.
