Prayer: Writ Petition filed under Article 226 of Constitution of India, to issue a Writ of Mandamus, to direct the respondents 1 & 2 to remove the encroachment made by the respondents 3 to 6 in S.No.596/1 (street) and S.No.504 (odai) at Kaliamman Kovil Street, Surakaipatti, Aayartharmam Revenue Village, Watrap Taluk, Virudhunagar District on the basis of the representation of the petitioner dated 16.01.2025.

ORDER

Heard the learned counsel for the petitioner and the learned Government Advocate for R1 & R2 and the learned Additional Government Pleader for R3. Issuance of notice to the private respondents is dispensed with.

2. The petitioner alleges that there are encroachments in Survey No. 596/1 and Survey No.504, Kaliamman Kovil Street, Suraikaipatti.

3. The learned Government Advocate confirms that Survey No.596/1 is a street and Survey No.504 is a odai.

4. We direct the second respondent to conduct survey forthwith. Notices will be issued to all the interested parties. If the results of the survey indicate that there are encroachments, action shall be taken as per law to have the encroachment removed and the principles of natural justice will be scrupulously complied with. Proper enquiry must be held. Individual notices to all the encroachers will have to be sent. The entire exercise shall be completed within a period of five months from the date of receipt of a copy of this order. The writ petition is disposed of accordingly. No costs.
