ORDER : The Court Made the following order :- The petitioner is the husband of the defacto complainant. He apprehends arrest at the hands of the respondent police for the offence punishable under Sections 498(A), 294(b) and 506(ii) of I.P.C., and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act in Crime No.8 of 2018, on the file of the respondent police, seeks anticipatory bail.
2. The petitioner has two children through the defacto complainant and the children are presently with the defacto complainant.
3. The petitioner's counsel on instructions of the petitioner undertakes to remit a sum of Rs.3,000/-(Rupees Three Thousand only) every month in the bank account of the defacto complainant. This liability will commence from 01.07.2018 onwards. Of course this is an interim arrangement and it is open to the parties to resolve their disputes in the manner known to law.
4. In view of the above, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate, Thirumangalam and executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned https://hcservices.ecourts.gov.in/hcservices/
and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. Scrupulously.
5. The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
