Rajeshwari : Respondent/Complainant PRAYER: Criminal Revision Case is filed under Sections 397 and 401 of the Criminal Procedure Code praying to admit this revision on file, to call for the records from the lower Court and to duly set aside the order passed by the Family Court, Madurai, Madurai District in M.C.No.47 of 2013, dated 13.11.2014 by allowing this revision.

ORDER

****** During the pendency of this case, the matter was referred to the Tamil Nadu Mediation and Conciliation Centre, attached to this Bench, where the parties have entered into a compromise on 10.01.2018. The Mediation Centre has sent a report dated 10.01.2018 enclosing the compromise memo, which reads as under: "(1) The petitioner hereby agreed to pay a sum of Rs.4,00,000/- to the respondent as amicable settlement for closing of M.C.No.47 of 2013 on the file of the Family Court, Madurai and to file a petition for divorce on mutual consent by both parties before the Family Court, Madurai.

(2) The respondent hereby undertakes that she would not make any claim of any future maintenance and right over the properties of petitioner.

(3) For the above terms the petitioner today a sum of Rs.2,00,000/- as part of Rs.4,00,000/- total settlement paid through DD No.373084, dated 05.01.2018 drawn in favour of the respondent namely Rajeshwari and also the petitioner paid Rs.21,500/- towards cash payment on today 10.01.2018, as per order passed in Crl.R.C.(MD)No.899 of 2017, dated 05.12.2017.

(4) That remaining Rs.2,00,000/- will be paid at the time of ordering of Section 13-B of Hindu Marriage Act, passed by Family Court."
