The petitioner is before this Court seeking issuance of a writ of mandamus directing the second respondent to approve the building plan submitted by the petitioner vide Application No. 40394-2026-SZ, pertaining to Survey No. 119/11, situated at Thumbacode Village, Kalkulam Taluk, Kanyakumari District.
2. Pursuant to the said application, the second respondent issued a notice seeking clarification with regard to discrepancies noted among the patta, registered sale deed, building plan, and the width of the road. The petitioner claims to have submitted a detailed explanation dated 28.02.2026, along with all requisite documents. The grievance of the petitioner is that, despite submitting the explanation, the second respondent has not considered the application for approval of the building plan.
3. Mr. N. Ramesh Arumugam, learned Government Advocate appearing for the second respondent, on instructions, submitted that the 2/5
petitioner's application will be considered in accordance with law within a time frame to be stipulated by this Court. The said submission is placed on record.
4. In view of the above, the writ petition is disposed of with a direction to the second respondent to consider the petitioner's application dated 24.01.2026 bearing Application No. 40394-2026-SZ, on its own merits and in accordance with law, after taking into account the explanation submitted by the petitioner dated 28.02.2026 and the documents enclosed therewith.
5. The aforesaid exercise shall be completed within a period of six
(6) weeks from the date of receipt of a copy of this order.
6. There shall be no order as to costs.
