ORDER : The Court Made the following order :- The petitioner has filed this Criminal Original Petition seeking grant of anticipatory bail for the offences under Sections 498(A), 506 (i), 294(b) and 120-B of I.P.C and under Section 4 of the Tamil Nadu Prohibition of Women Harassment Act in Crime No.Not known of 2018.
2.Heard the learned counsel appearing for the petitioner as well as the learned Government Advocate (Crl. side) appearing for the respondent and the learned counsel appearing for the intervener. 3.The learned counsel appearing for the petitioner has filed an affidavit admitting that the petitioner had pledged 18 Sovereigns of gold belonging to the de facto complainant for the purpose of taking treatment for his father. He undertakes that the pledged jewels would be redeemed and handed over to the de facto complainant in front of the respondent Police on or before 11.08.2018. This undertaking given by the petitioner is recorded. 4.The de facto complainant is having one year old child through the petitioner. Therefore, it is seen that the de facto complainant has filed maintenance case against the petitioner. Subject to the out come of the maintenance proceedings, the petitioner is directed https://hcservices.ecourts.gov.in/hcservices/
to pay a sum of Rs.6,000/- for maintaining the de facto complainant as well as the child. Therefore, these two conditions have been imposed on the petitioner.
(i).Return of admitted jewellery.
(ii).Paying maintenance to the de facto complainant, every month and the liability shall commence from August 2018 onwards. 5.The de facto complainant shall furnish her bank details to the petitioner's counsel. If these conditions are breached, it would be open to the de facto complainant to move this Court for cancellation of anticipatory bail.
6.Subject to these twin conditions, this Court is inclined to grant anticipatory bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.II, Usilmapatti, Madurai District and on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioner shall appear before the respondent police as and when required for interrogation. The petitioner shall comply with the conditions stipulated under Section 438 Cr.P.C. scrupulously. 7.The petitioner shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail shall stand dismissed.
