ORDER : The Court Made the following order :- The petitioners are accused Nos.2,4,7 and 12. They were arrested and remanded to judicial custody on 10.05.2018 for the offences punishable under Sections 147, 148, 302 IPC in Crime No.188 of 2018, on the file of the respondent police. They seek bail. 2.The learned counsel for the petitioner withdraws the bail petition as far as the petitioners 1 to 3 concerned. The fourth petitioner is not a named accused in the First Information Report. However, his rank was not assigned as A-12. The fourth petitioner is not having any previous case.

3. Considering the said fact, this Court is inclined to grant bail to the fourth petitioner with certain conditions. Accordingly, the fourth petitioner is ordered to be released on bail, subject to the following conditions;

(i) the fourth petitioner shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.2, Virudhunagar;

ii) the fourth petitioner is directed to appear before the respondent police as and when required for interrogation; (iii)on breach of any of the aforesaid conditions, the Magistrate/Trial Court is entitled to take appropriate action against the fourth petitioner in accordance with law as if the conditions have been imposed and the fourth petitioner released on bail by the Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005) AIR SCW 5560].
