O R D E R

This petition has been filed, seeking to expedite the trail in H.M.O.P.No.528 of 2017 on the file of the Sub Judge, Thirumangalam (Old No.H.M.O.P.No.526 of 2013 on the file of the II Sub Court (Camp Court), Thirumangalam, Madurai District).

2. It is seen that the petitioner has initially filed H.M.O.P.No.526 of 2013 before the II Sub Court (Camp Court), Thirumangalam, Madurai District and after transferring the said case on the ground of jurisdictional point of view, a new number has been assigned as H.M.O.P.No.528 of 2017 and the same is pending on the file of learned Sub Judge, Thirumangalam without any progress. Under such circumstances, the petitioner has come up with the above prayer.

3. Admittedly, the H.M.O.P.No.526 of 2013 was filed in the year 2013; that it was transferred only in the year 2017 and it is pending for more than four years. Therefore, without issuing notice to the respondent, this Court is inclined to pass an order, directing the learned Sub Judge, Thirumangalam to dispose of the case in H.M.O.P.No.528 of 2017 within a period of four months from the date of receipt of a copy of this order without giving any adjournment to either parties at any cost, after giving opportunity to both parties to put forth their case. https://hcservices.ecourts.gov.in/hcservices/

With the above direction, this petition is disposed of. No costs.
