ORDER

Seeking to direct the respondents to take appropriate action on the representation of the petitioner dated 23.01.2026, this writ petition is filed.

2. The learned counsel for the petitioner submitted that the petitioner is residing at Nenjathur along with his family. On 23.01.2026 at about 5:00 P.M. one Karthick, along with his mother, Vimala, entered into a physical altercation with Selvakrishnan, the de facto complainant in crime No.26 of 2026. While being so, the petitioner had interfered to rescue the said Selvakrishnan, in which Karthick had brutally attacked the petitioner with a wooden log on his head, causing severe head injuries in which the petitioner had become unconscious. He was taken to Ilayangudi Government Hospital and thereafter admitted at Government Medical College Hospital, Sivagangi, for further treatment.

3. In this regard, the said Selvakrishnan had lodged a criminal complaint against the said Karthick and his mother before the second respondent police, in which a first information report in FIR 2/6

No.28 of 2026 was registered on 23.01.2026 against the said Karthick and Vimala. In the meanwhile, the petitioner was further admitted at Hannah Joseph Hospital in Madurai for intensive treatment on 24.01.2026, and after taking proper treatment, he was discharged on 05.02.2026. The petitioner has given a representation on 23.01.2026 to take necessary action as against the offenders, which still remains unattended. Hence, this writ petition is filed.

4. The learned Government Advocate Mr.S.S.Manoj submitted that the representation was already received by the second respondent and they are looking into it.

5. Heard the learned counsels on either side and carefully perused the materials available on record.

On careful consideration of the facts involved, it is seen that in a physical altercation which had erupted between one Selvakrishnan and Karthick and his mother Vimala, the petitioner had interfered to rescue the said Selvakrishnan, in which he was also injured. Hence, the injury sustained by the petitioner had also 3/6

arisen out of the alleged offences in crime No.28 of 2026. In this regard, the second respondent police is directed to alter the First Information Report, adding the details of the complaint given by the petitioner by his representation dated 23.01.2026 and 02.03.2026 and further directed to conduct an investigation in the manner known to law and conclude the same within a period of four (4) weeks from the date of receipt of a copy of this order. After considering the representation, the necessary alteration report should be filed in crime No.28 of 2026 before the jurisdictional Magistrate.
