Prayer:- Criminal Original Petition filed under Section 482 of Cr.P.C., to call for the records in Crime No.262 of 2016 dated 14.05.2016 on the file of the respondent police and quash the same. ORDER:- This Petition coming on for hearing on this day, upon perusing the petition, the earlier order of this Court dated 27/02/2020 and the letter in Dis.No.60/2021, dated 12/03/2021 submitted by the Additional Chief Metropolitan Magistrate (E.O.II), Egmore, Chennai, this Court made the following order: This Court, in Crl.O.P.(MD)No.23999 of 2016, directed the learned Additional Chief Metropolitan Magistrate, Chennai, to speed up the trial in E.O.C.Nos.391 to 393 of 2018 and conclude the trial on merits and in accordance with law within a period of six months from the date of receipt of a copy of that order. The order was passed on 27.02.2020.
2. Now the learned Additional Chief Metropolitan Magistrate, Chennai, addressed his letter dated 12.03.2021, in Dis No.60/2021, seeking 8 months further time for disposal of that cases. It is stated in the letter that he has taken over the charge of the post of Additional Chief Metropolitan Magistrate (E.O.II) on 08.02.2021. The previous Presiding Officer was transferred on 04.12.2020 and the Additional Chief Metropolitan Magistrate (E.O.I) was holding full additional charge of Additional Chief Metropolitan Magistrate (E.O.II). Due to Covid-19 restrictions, the appearance of the parties were not allowed from 27.03.2020 to 08.02.2021. Therefore, https://hcservices.ecourts.gov.in/hcservices/
there was no progress made in the trial.
3. Considering the reasons stated for not concluding the trial as directed earlier, further time of five (5) months is granted for disposal of the cases in E.O.C.Nos.391 to 393 of 2018, on merits and in accordance with law, from the date of receipt of a copy of this order.
