ORDER
This Writ Petition has been filed for the issue of a Writ of Mandamus directing the first respondent to dispose of the Second Appeal pending in Diary No.117294/2020, dated 25.06.2020, within the time limit stipulated by this Court.
2. The case of the petitioner is that he is a direct selling agent, who had rendered his service for nearly four years in the fifth respondent Bank. The petitioner submitted an application before the third respondent through a representation dated 30.09.2019 seeking for some information and the petitioner was not satisfied with the order passed by the third respondent on 18.02.2020. Aggrieved by the same, the petitioner filed an appeal before the second respondent on 21.02.2020 and no steps were taken to dispose of the appeal. Aggrieved by the same, Second Appeal was filed before the first respondent in Diary No.117294/2020, dated 25.06.2020. The grievance of the petitioner is that this second appeal has not been taken up for hearing or disposed of and hence, the present Writ Petition has been filed before this Court.
3. Heard Mr.N.Dilip Kumar, learned Standing Counsel appearing for the respondents 2 to 5 and Mr.M.Lingadurai, learned Government Advocate (Civil) appearing for the sixth respondent.
4. When the matter came up for admission on 30.04.2021, this Court ordered notice and private notice to the first respondent. Notice has been served on the first respondent and the name has also been printed in the cause list. However, there is no representation for the first respondent.
5. Taking into consideration the facts and circumstances of the case and the relief sought for in this Writ Petition, there shall be a direction to the first respondent to dispose of the Second Appeal filed by the petitioner in Diary No.117294/2020, dated 25.06.2020, in accordance with law, within a period of thirty (30) days from the date of receipt of a copy of this order.
6. The petitioner is directed to make a representation to the first respondent along with a copy of this order. 2/3
