ORDER: The Court made the following order :- The petitioner, who was arrested and remanded to judicial custody on 16.02.2026, for the offences punishable under Sections 333 and 311 of BNS, on the file of the respondent police, seek bail. 1/5
2.The case of the prosecution is that on 10.02.2026, the petitioner is alleged to have trespassed into the house of the defacto complainant and snatched a gold chain weighing about 71⁄2 sovereigns belonging to the defacto complainant by criminally intimidating her with an aruval. She also caused injury to the defacto complainant. Hence, the defacto complainant made a complaint. Therefore, the above said case has been registered for the above said offences.
3. The learned counsel for the petitioner submits that the petitioner is in custody from 16.02.2026 and she is confined in the prison from that date. He would further submit that the petitioner is now in advanced stage of pregnancy. Hence, he sought bail for the petitioner.
4. The learned Additional Public Prosecutor appearing for the respondent police strongly opposed for grant of bail. However, he affirmed the statement that the petitioner is in advanced stage of pregnancy. She has no previous case. The stolen articles were recovered.
5.Considering the special circumstances of the case, that the petitioner is now in advanced stage of pregnancy, the period of incarceration and she has no 2/5
previous case, this Court is inclined to grant bail to the petitioner with certain conditions.
6.Accordingly, this Criminal Original Petition is allowed and the petitioner is ordered to be released on bail, on executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Nanguneri, and on further conditions that, (a)the sureties shall affix their photographs and left thumb impression in the surety bond and the Magistrate/concerned court may obtain a copy of their Aadhar card or Bank Pass Book to ensure their identity; (b)the petitioner is directed to appear before the respondent police on the first working day of every month at 10.30 a.m., until further orders.
(c)the petitioner shall not tamper with evidence or witness; (d)the petitioner shall not abscond during trial; (e)On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs.
[(2005)AIR SCW 5560].
(f) If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
