Prayer: These Civil Revision Petitions are filed under Section 227 of the Constitution of India to direct the learned I Additional Subordinate Judge, Tiruchirapalli to dispose the Execution Petition in E.P.Nos.392 to 395 of 2014 in M.C.Nos.164, 167, 165, 166 of 2003 respectively, within the time stipulated by this Hon'ble Court.
For Petitioner in all CRPs. : Mr.Ananth C.Rajesh ***** COMMON ORDER These Civil Revision Petitions are filed to dispose of the Execution petition in E.P.Nos.392 to 395 of 2014 in M.C.Nos.164, 167, 165, 166 of 2003 respectively, on the file of the I Additional Subordinate Judge, Tiruchirapalli. 2.The revision petitioner / Judgment holder in MC Nos.164 of 2003 to 167 of 2003, is not able to see the fruits of the award, though the award was passed as earlier as on 23.05.2005, due to the dilated tactics adopted by the Judgment Debtors. https://hcservices.ecourts.gov.in/hcservices/
3.Presently, these four Revision Petitions are filed to expedite the Execution Proceedings in E.P.Nos.392 to 395 of 2014, as early as possible, since some of the Judgment Debtors, likely to retire and the garnishee may not be in a posion to attach the salary and satisfy the decree.
4.The notes paper of the Court below indicates that since 07.10.2015, there is no progress in the execution petitions. 5.It is also now reported by the learned Counsel for the revision petitioner that there is no Presiding Officer for the I Additional Subordinate Court, Tiruchirapalli. It is contended by the learned Counsel for the petitioner that the learned III Additional Subordinate Judge, is in-charge of this Court and date may be fixed, directing the Presiding Officer, to take up the matter on day today basis at the earliest and dispose the petitions not later by 30.06.2017, since one of the Judgment Debtors, by name, Nargis Nayakara, W/o.Fredrick, is likely to retire on 30.06.2017.
6.Taking note of the long delay in disposal of these Execution Petitions, this Court constrained to direct the Presiding Officer, who is in-charge of the matter, to take up the case on day today basis and disposed of the petitions, at the earliest. On any event, not later by 15.07.2017.
7.Accordingly, these Civil Revision Petitions are disposed of with the above direction. No costs.
