Prayer : Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023, to issue a direction directing the Principal District Munsif cum Judicial Magistrate Court, Eraniel, Kanniyakumari District to complete the trial proceedings in C.C No.121 of 2016 in Crime No.2 of 2016 dated 11.01.2016 on the file of the respondent police station under Section 498(A), 406, 506 (ii) of IPC and Section 4 of TNPWH Act & Sections 3, 4, 6 of Dowry Prohibition Act, within the time stipulated by this Court.

This petition has been filed by the petitioner to direct the Principal District Munsif cum Judicial Magistrate Court, Eraniel, Kanniyakumari District to complete the trial proceedings in C.C No.121 of 2016, within the stipulated time.
2. According to the petitioner, he is the accused no.1 in this case and the F.I.R has been registered in the year 2016. Thereafter, the first respondent has filed the final report and the Trial Court also has taken cognizance in C.C.No.121 of 2016 and the same is pending for the past nine years without completing the trial. Therefore, he has filed this petition.

The learned Additional Public Prosecutor (Criminal Side) appearing for the first respondent would submit that the case is posted for examination of other witnesses and already L.W.1 to 4 were examined as P.W.1 to 4 and they will cooperate for the speedy disposal of the case and they will produce the witnesses as directed by the Trial Court.
4. According to the petitioner, the case is pending from the year 2016 without completing the Trial. The first respondent has also admitted the pendency of the case. Now the case is posted for the examination of further witness and already P.W.1 to 4 were examined. Therefore, it is appropriate 2/4
to direct the Principal District Munsif cum Judicial Magistrate Court, Eraniel to dispose of the case in C.C.No.121 of 2016 as early as possible without giving any long adjournment beyond fifteen days.
5. With the above said direction, this criminal original petition is disposed of.
