No.5694 of 2019 :- Criminal Miscellaneous Petition is filed under section 482 of Criminal Procedure Code, praying this Hon'ble Court to restore the above Crl.OP(MD)No.8255 of 2015 on the file of this Honourable Court, which had been dismissed for Non Prosecution on 22.10.2018. Prayer in CRL OP(MD). 8255 of 2015 :

Criminal Original Petition is filed under section 482 of Criminal Procedure Code, Praying this Hon'ble Court to call for the records relating to the impugned FIR in Crime No.90 of 2015 on the file of the Inspector of Police, Paramakudi Police station, Ramnad District, quash the same.

ORDER:- This Petition is coming on for hearing on this day and upon perusing the petition and the affidavit filed in support thereof and upon hearing the arguments of MR.A.THIRUVADI KUMAR, Advocate for the Petitioner and of MR.K.SUYAMBULINGA BHARATHI, Government Advocate(Criminal Side)on behalf of the 1st Respondent, this Court made the following order:

This petition has been filed to restore the case in Crl.O.P. (MD).No.8255 of 2015, which was dismissed for non prosecution on 22.10.2018 by this Court.

2.The learned counsel engaged in this case on behalf of the petitioners has been appointed as Special Government Pleader at the Madurai Bench of Madras High Court. When the matter was taken up for hearing on 22.10.2018, she did not appear and it was dismissed for default. Hence, in order to restore the same, the present petition has been filed.

3.Heard the learned counsel on either side.
