PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C., praying to direct the respondents 1 and 2 to transfer the investigation in Crime No.126 of 2012 from the file of the fifth respondent to the file of the sixth respondent. ORDER
This Criminal Original Petition has been filed to direct the respondents 1 and 2 to transfer the investigation in Crime No.126 of 2012 from the file of the fifth respondent to the file of the sixth respondent.
2. The learned Additional Public Prosecutor (Criminal Side) submitted that the fifth respondent after registering the FIR in Crime No.126 of 2012, had completed the investigation and filed a final report before the learned Judicial Magistrate, Sathankulam and it is pending in P.R.C.No.4 of 2022. Therefore, no investigation is pending on the file of the fifth respondent and as such, the question of transfer of investigation does not arise.
3. This Criminal Original Petition is dismissed. However, the petitioner is at liberty to file appropriate petition before the appropriate Court, if so advised.
