ORDER

This Criminal Original Petition has been filed for issuing a direction to the respondents 1 and 2 to transfer the investigation of the First Information Report in connection with the case in Crime No.9 of 2023, dated 07.01.2023, pending on the file of the 3rd respondent police to any other competent authority or CBCID , Tenkasi District to conduct the fair investigation.

2. The grievance of the petitioner is that even after the lapse of four months the missing trailer could not be traced and hence, he seeks transfer of investigation from the file of the third respondent to any other competent authority.

3. The learned Additional Public Prosecutor appearing for 2/5

the respondent police would submit that so far no clue is available and they also enquired several suspected persons asking about several questions.

4. There is no question of transfer of investigation. The 3rd respondent is directed to conduit the investigation in a proper manner and complete the same within a period of five months from the date of receipt of a copy of this order and the same has to be monitored by the 2nd respondent.

5. This Criminal Original Petition is disposed of accordingly.
