Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India praying for the issuance of a Writ of declaration declaring the election held on 18.09.2014 for Ward No.1 of Thalakkavur Panchayat, Kallal Union, Karaikudi Taluk, Sivagangai District is prima facie illegal and invalid and further declare that the election of third respondent as a Ward Member for Ward No.1 of Thalakkavur Panchayat, Kallal Union, Karaikudi Taluk, Sivagangai District is also illegal and and invalid as violative of Section 26(1) of Tamil Nadu Panchayats Election Rules, 1995 and to direct the respondents No.1 and 2 to take appropriate steps for re-election in accordance with the law within stipulated time. For Petitioner : No appearance For Respondent No.1 : Mr.S.Kumar, Additional Government Pleader.

When the matter was taken up for hearing on 13.07.2017, there was no representation on the behalf of the petitioner. Hence, the matter was directed to be posted on 14.07.2017 (today) under the caption for dismissal. Even today, when the matter is taken up for hearing, there is no representation on behalf of the petitioner. Therefore, this writ petition is dismissed for nonprosecution. Consequently, connected Miscellaneous Petition is dismissed. No costs.
